2010 Charitable Gaming Legislative Changes
(LB 879 – Revenue Committee –Effective date is July 1, 2010)
[Sections 1 and 21] Eliminates the funding of the State Athletic Commission, with charitable gaming tax revenue.
(LB 861 — General Affairs Committee – Effective date is July 15, 2010)
[Section 3] Amends §9-647 of the Nebraska County and City Lottery Act to permit keno to be played after 1:00 a.m. if a local municipality votes to extend the serving of alcohol until 2:00am within its jurisdiction pursuant to a vote under §53-179 of the Nebraska Liquor Control Act.
(LB 888 — Banking, Commerce and Insurance Committee – Effective date is January 1, 2011 and January 1, 2013)
(Note: Relates to Limited Liability Companies only) Phases out the Nebraska’s Limited Liability Company Act (effective January 1, 2013) and replaces it with the Nebraska Uniform Limited Liability Act (effective January 1, 2011). The new act clarifies the duties of loyalty and care that members owe the company and one another and their ability to define and limit those duties. Provides for perpetual duration of the company and preserves the distinction between manager-managed and member-managed LLCs while giving new attention to the authority of members to bind the company.
